Terms of Service
Effective Date: January 1, 2026
Last Updated: October 2026
These Terms of Service (“Terms”) govern your access to and use of the website (camelliabuildtech.com) and the architectural design, Building Information Modeling (BIM), CAD drafting, reality capture, and 3D visualization services provided by Camellia Buildtech (“Company”, “we”, “our”, or “us”).
By requesting a quotation, submitting technical project files, or utilizing our engineering deliverables, you agree to be bound by these Terms and any Project Agreement or Statement of Work (“SOW”) executed between the parties.
1. Services & Scope of Work
Camellia Buildtech delivers specialized technical production services including Architectural, Structural, and MEP BIM Modeling, 2D CAD Drafting, Scan to BIM / Scan to CAD, Clash Detection & Coordination, Construction Documentation, and 3D Rendering.
- Each engagement is defined by an approved Statement of Work (SOW), proposal, or written project brief detailing scope, milestones, formats (e.g., Revit .rvt, AutoCAD .dwg, Navisworks .nwd, IFC), and deliverable schedules.
- Changes or additions to project scope requested after project kickoff will be subject to a mutually agreed Change Order.
2. Intellectual Property & Ownership
- Client Ownership: You retain full, exclusive ownership of all proprietary architectural sketches, design concepts, engineering calculations, and source files submitted to us. Upon full payment of agreed fees, all custom drawings and models generated specifically for your project become your intellectual property.
- Company Methodologies: Camellia Buildtech retains ownership of its pre-existing templates, standard parametric families, automation scripts, and proprietary internal workflows used during production.
- Confidentiality: Both parties agree to maintain strict confidentiality over proprietary technical drawings and commercially sensitive information. Non-Disclosure Agreements (NDAs) govern all client projects.
3. Professional Review & Client Responsibility
Camellia Buildtech provides specialized production, drafting, and digital modeling support services. Our deliverables do not constitute licensed architectural or professional engineering (PE) stampings unless explicitly contracted under a certified local engineer of record. The client or their licensed design professional remains responsible for the final review, code verification, permitting compliance, and field validation of all construction drawings prior to fabrication or site erection.
4. Quotations, Fees & Payment Terms
- Quotations are provided based on the scope, level of development (LOD), and schedule agreed upon in the initial project brief. Fixed-rate and hourly billing options are available.
- Invoices are due upon the schedule specified in the applicable invoice or SOW. Milestone payments or retainer deposits may be required for multi-phase projects.
- Timely payment ensures continuity of project milestones and model delivery.
5. Revisions & Quality Assurance
We stand behind our work with rigorous quality checks. Standard engagements include revision cycles to address drafting inaccuracies or model clashes relative to the original client-provided scope. Revisions arising from subsequent design redesigns, architectural changes, or revised owner briefs after sign-off will be quoted as scope revisions.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Camellia Buildtech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, construction delays, or business interruption arising from or relating to the use of our services or website. Our total aggregate liability for any claim shall not exceed the total fees paid by the client for the specific project deliverable giving rise to the claim.
7. Termination
Either party may terminate an engagement upon written notice if the other party materially breaches these Terms and fails to cure such breach within fifteen (15) business days. In the event of early termination, the client shall pay for all work completed up to the termination date.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
